Mediation
Mediation is a neutral forum where an impartial third-party, the mediator, works with the parties to facilitate communication to promote reconciliation, settlement, or understanding between the parties. For general mediation law in Texas, see Texas Civil Practice and Remedies Code, Chapter 154.
Arbitration
Arbitration allows the parties to submit their conflicts to an impartial person or panel for a final and binding decision, known as an "award", submitting evidence and making argument. For general arbitration law in Texas, see Texas Civil Practice and Remedies Code, Chapter 171.
Consultation
Attorneys sometimes become too close to the facts of the case and/or the desires of their clients to develop an alternative course of action. Discussion of the case with an objective, experienced third-party can lead to creative resolution and more desirable outcomes.
Special Judge
Texas allows the referral of any or all issues in controversy to a special judge for trial. This can expedite the trial of the case and facilitate resolution. For general Texas law on trial by special judge, see Texas Civil Practice and Remedies Code, Chapter 151.
Witness Preparation
For many parties, the aspect of testifying is a frightening thought. Helping the witness to prepare for giving testimony, whether in the courtroom or in deposition, can significantly reduce the witness's anxiety and produce more effective testimony.
